Meeting Minutes
November 24, 2008

OTHERS PRESENT: Andrea Crete, Board of Health Agent, Debra Sciascia, Recording Secretary

M. Waite called the Board of Health Meeting to order at 5:00 PM

MEETING MINUTES:

October 27, 2008:  M. Waite motioned to approve.  M. Ricker seconded.  Approved.

SEPTIC PLAN REVIEWS:

47 Mixter Road:  John E. Finlay for Sean A. Xenos.  Complete septic repair.  Sean Xenos represented the plans.  He believes it is a two (2) bedroom house.  The septic system is designed for a 3 bedroom house.  A Local Upgrade Approval is requested for a 3 foot offset to groundwater in the SAS.  A. Crete will check with the assessor’s office to verify if it is two or three bedrooms.  Granting of the Local Upgrade Approval will be dependent on the number of existing bedrooms.
Condition(s):
The old system must be decommissioned per Title 5.
Dig Safe must be notified and noted on the plans.

M. Waite motioned to approve with the above conditions 1 – 2.  M. Ricker seconded.  All in favor, approved.

OTHER BUSINESS:

Grease Traps:  A. Crete gave the Board a copy of the letter regarding grease traps that will be going out with the applications for food renewal licenses in December.  Board discussion.

Wood Burning Complaint:  Richard and Linda Martino, 3 Hawthorne Road are the residents that have a complaint about the wood burning smoke at 1 Hawthorne Road, the Lambert residence.  They addressed the Board, with their Attorney, Gary Peters, asking to abate conditions from smoke relief, submitting pictures.

1 Hawthorne Rd. has two chimneys, one for the boiler, and one for an existing wood stove.  The Martino house is about 60 feet from the chimney.  They stated that there is a cap atop the wood stove chimney, and
the smoke blows sideways out of it.  They submitted a letter from other neighbors stating they could smell wood smoke from their homes, not specifying 1 Hawthorne as the source.
The problem is the elevation of their house in relation to 1 Hawthorne’s chimney.  Their house is east of 1 Hawthorne Road.  R. Martino stated nights and weekends are when they feel there is a problem with the wood burning.

A Crete has gone out twice upon complaint and could not smell smoke in the house or permeating on fabric.  There was a slight smell in the breezeway and outside.  She has also given the residents at 1 Hawthorne instructions on how to properly burn wood and the health affects of wood smoke.  A Crete does not feel issuing a cease and desist order to abate wood burning is necessary.

M. Waite stated that the Board would take it under advisement, and Attorney Gary Peters stated that if the Board does not take action, there will be a lawsuit, and the Board of Health will be involved.

M. Waite said the Board would take it under advisement.  A. Crete will contact Town Counsel, and ask Dennis Lipka, Building Commissioner to drive by and take a look at the chimney in relation to height and type of chimney.  The residents were informed that they could still call A. Crete during work hours to investigate future complaints.  G. Peters said he would drop off larger pictures to the Board of Health office.

Next Meeting:  Tentatively for December 15, 2008 at 5:00 PM, and/or January 12, 2009.

M. Waite motioned to adjourn the Board of Health meeting.  M. Ricker seconded.  All in favor.
